These Terms & Conditions (the “Terms”) govern your use of kytdentalservices.com and the SMS messaging programs operated by KYT Dental Services Inc. (“KYT,” “we,” “us,” or “our”). By using our website or enrolling in any of our messaging programs, you agree to these Terms.

Eligibility

You must be at least 18 years old and a U.S. resident to enroll in any KYT messaging program. By enrolling, you confirm that the mobile number you provide belongs to you and that you are authorized to receive messages at that number.

SMS Messaging Programs

KYT operates two text messaging programs through Twilio. Each is opt-in, separate from the other, and governed by the terms in this section.

KYT Rewards Program (Patients)

• Description. A patient loyalty program. Messages may include rewards updates, point balances, redemption confirmations, and related program notifications.
• How to opt in. Submit your mobile number through our website form, an in-office form, or by replying with consent to a KYT-initiated message. You may be asked to confirm enrollment with a one-time verification message.
• Frequency. Message frequency varies based on your activity in the program.
• Cost. Message and data rates may apply, depending on your wireless plan. KYT does not charge a fee to participate.
• Opt out. Reply STOP to any message to unsubscribe. You will receive a confirmation message and no further messages from this program.
• Help. Reply HELP for assistance, or contact us at support@kytdentalservices.com.

Staff Notifications Program (Internal)

• Description. An internal program for KYT employees and contractors only. Messages may include call-out alerts to supervisors, shift coverage requests, and operational notifications.
• How to opt in. Staff opt in during onboarding or by request to a supervisor.
• Frequency. Message frequency varies based on operational needs.
• Cost. Message and data rates may apply, depending on your wireless plan.
• Opt out. Reply STOP to any message to unsubscribe. You may also request removal directly from a supervisor or by emailing support@kytdentalservices.com.
• Help. Reply HELP for assistance.

Mobile Information

No mobile information collected through KYT’s SMS programs — including phone numbers and consent information — will be shared with third parties or affiliates for marketing or promotional purposes. Information is shared only with service providers (such as Twilio) used to deliver messages on our behalf, and only as needed to operate these programs. See our Privacy Policy for details.

Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. KYT does not control delivery of SMS messages over carrier networks and is not responsible for the availability or performance of any carrier service.

Modification or Termination of Programs

We may modify, suspend, or terminate any messaging program at any time, with or without notice. We may also remove a participant from a program at our discretion (for example, if a number becomes invalid, the participant requests removal, or continued participation is inconsistent with the program’s purpose).

Disclaimer

The website, services, and messaging programs are provided “as is” without warranties of any kind, whether express or implied. KYT does not warrant that the website or messaging programs will be uninterrupted, error-free, or free from harmful components. Information on the website is provided for general informational purposes and is not a substitute for professional dental advice, diagnosis, or treatment.

Limitation of Liability

To the fullest extent permitted by law, KYT will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the website or any messaging program, including but not limited to missed, delayed, or undelivered messages.

Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of our services will be brought in the state or federal courts located in Orange County, California.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective” date above. Continued use of the website or messaging programs after a change constitutes acceptance of the updated Terms.
